The importance of the Build America, Buy America Act in 2025
To be BAA compliant a manufacturer requires a “domestic end product” be manufactured, mined or produced in the Unites States and more than 55% of the cost of the components in the product be manufactured in the United States. This is much stricter than TAA criteria where products are considered TAA compliant if they are manufactured or substantially transformed in the United States or any of the TAA designated countries.

- All iron and steel items used in the project are produced in the United States. This means all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States.
- All manufactured products used in the project are produced in the United States. This means the manufactured product was manufactured in the United States; and the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States is greater than 55% of the total cost of all components of the manufactured product.
- All construction materials are manufactured in the United States—this means that all manufacturing processes for the construction material occurred in the United States.
To determine BAA Compliance vs. TAA, you need to first identify the end-product to be delivered and the place of manufacture of the end-product. Said another way, if not manufactured in the United States, it is not BAA compliant.
There has never been a more important time for products to be BAA compliant. First and foremost, BAA compliance protects U.S. jobs! It also strengthens domestic supply chains and incentivizes federal agencies to purchase American-made goods.
But now with so much uncertainty around tariffs and supply chains it makes even more sense to ensure that you have a BAA provider that can supply products in 2025.
